SCAPIN 677 : 해방직후 연합군 총사령관의 일본 통치권에서 제외되는 영토에 대한 규정 (1945년)

 

 

일본이 1945년 9월 2일 항복문서에 조인한 후, 동경에 '연합국 최고사령부(General Headquarters Supreme Commander for the Allede Powers : 약칭 GHQ)는 일본영토를 규정하는 작업을 진행한다.

이것이 1946년 1월 29일 작성된 SCAPIN 제677호이다(SCAPIN : Supreme Command Allied Powers Instruction ; [약간의 주변 지역을 정치상 행정상 일본으로부터 분리하는데 관한 각서]). 이 SCAPIN 제677호의 제3조에는 “일본은 일본의 4개 本島(北海島·本州·九州·四國)와 약 1천 개의 더 작은 인접 섬들을 포함한다고 정의된다.
… 그리고 제외되는 것은 鬱陵島·리앙쿠르岩(Liancourt Rocks ; 獨島, 竹島)·濟州島 등이다” 고 규정하여 '독도'(Liancourt Rocks, 竹島) 등을 일본영토에서 분리한다고 명확하게 규정했다.

1946년 1월 29일 SCAPIN 제677호는 연합국 최고사령부가 '독도'(리앙쿠르섬, 죽도)를 원래의 주인인 한국으로 반환하기로 결정하고 일본으로부터 분리했다는 점에서 매우 중요한 기록이다.

MEMORANDUM FOR : IMPERIAL JAPANESE GOVERNMENT
THROUGH            : Central Liaison office, Tokyo
SUBJECT             : Governmental and Administrative Separation
                       of Certain Outlying Areas from Japan.

  1. The Imperial Japanese Government is directed to cease exercising, or attempting to exercise, governmental or administrative authority over any area outside of Japan, or over any government officials and employees or any other persons within such areas.

  2. Except as authorized by this Headquarters, the Imperial Japanese Government will not communicate with government officials and employees or with any other persons outside of Japan for any purpose other than the routine operation of authorized shipping, communications and weather services.

  3. For the purpose of this directive, Japan is defined to include the four main islands of Japan (Hokkaido, Honshu, Kyushu and Shinkoku) and the approximately 1,000 smaller adjacent islands, including the Tsushima Islands and the Ryukyu (Nansei) Islands north of 30°North Latitude (excluding Kuchinoshima Island), and excluding (a) Utsryo (Ullung) Island, Liancourt Rocks (Take Island) and Quelpart (Saishu or Cheju Island,  (b) the Ryukyu (Nansei) Islands south of 30°North Latitude (including Kuchinoshima Island), the Izu, Nanpo, Bonin (Ogasawara) and Volcano(Kazan or Iwo) Island Groups, and all the outlying Pacific Islands (including the Daito (Ohigashi or Oagari) Island Group, and Parece Vela (Okinotori), Marcus (Minami-tori) and Ganges Habomai (Hapomaze Island Group (including Suisho, Yuri, Akiyuri, Shibotsu and Taraku Islands) and Shikotan Island.

  4. Further areas specifically excluded from the governmental and administrative jurisdiction of the Imperial Japanese Government are the following : (a) all Pacific Islands seized or occupied under mandate or otherwise by Japan since the beginning of the World War in 1914, (b) Manchura, Formosa and the Pescadores, (c) Korea, and (d) Karafuto.

  5. The definition of Japan contained in this directive shall also apply to all future directives, memoranda and orders from this Headquarters unless otherwise specified therein.

  6. Nothing in this directive shall be construed as an indication of Allied policy relating to the ultimate determination of the minor islands referred to in Article 8 of the Postdam Declaration.

  7. The Imperial Japanese Government will prepare and submit to this Headquarters a report of all governmental agencies in Japan the functions of which pertain to areas outside a statement as defined in this directive. Such report will include a statement of the functions, organization and personnel of each of the agencies concerned.

  8. All records of the agencies referred to in paragraph 7above will be preserved and kept available for inspection by this Headquarters.

제 목:일본외곽지역에 대한 일본으로부터의 통치권적 행정적 분리

 1. 일본외부의 특정지역 또는 동 특정지역내 정부공무원 및 고용원 또는 기타 어떤 사람들에 대한 통치권적 또는 행정적 권위의 행사 또는 행사시도의 종결을 일본정부에 지시한다.

 2. 본 총사령부의 승인을 받은 경우를 제외하고, 일본제국정부는 승인된 해상운송, 통신 및 기상서비스에 관한 통상적 운영 외에는 일본외부에 있는 정부공무원 및 고용원과 기타 어떤 사람과도 통신을 해서는 안된다.

 3. 본 지령의 목적상 일본은 일본의 4개 도서(홋가이도, 혼슈, 큐우슈우 및 시코쿠)와 대마도를 포함한 약 1,000개의 인접한 보다 작은도서들과 북위 30도의 북쪽 유구(난세이) 열도(구찌노시마 도서 제외)로 한정되며, (a) 우쓰료(울릉)도, 리앙꼬르 암석(다케시마, 독도) 및 퀠파트(사이슈 또는 제주도), (b) 북위 30도 이남 유구(난세이) 열도(구찌노시마 섬 포함), 이즈, 난포, 보닌,(오가사와라) 및 화산(오시가시 또는 오아가리) 군도 및 파레스 벨라(오기노도리), 마아카스(미나미도리) 및 간지스(나까노도리) 도서들과 (c) 구릴(지시마) 열도, 하보마이(수우이쇼, 유리, 아까유리, 시보쓰 및 다라쿠 도서들 포함하는 하포마쓰 군도)와 시고탄도를 제외한다.

 4. 일본제국정부의 통치권적 및 행정적 관할로부터 특별히 제외된 이에 더한 지역은 다음과 같다. : (a) 1914년 제1차 세계대전 개시이래 신탁통치 또는 기타로 일본이 점령했거나 탈취한 모든 태평양의 도서들, (b) 만주, 대만 및 패스카도어 섬, (c) 코리아(Korea) 및 (d) 가라후도(화태).

 5. 본 지령내에 들어있는 일본의 정의는 달리 지령내에서 특별히 규정하지 않는 한 본 총사령부에서 발동하는 장차의 모든 지령, 각서 및 명령에도 적용된다.

 6. 본 지령내의 어떤 것도 '포츠담 선언'(8)에 언급된 작은 도서들에 관한 최종적 결정에 관련된 연합국정책의 표시로서 고려되어서는 안 된다.

 7. 일본제국정부는 본 지령내에 서술되어 있는 것 외의 지역을 관장하는 일본 내의 모든 정부기관에 관한 보고서를 작성하여 본 최고 사령부에 제출한다.

 8. 위 7항에 언급된 정부기관에 관한 모든 기록은 보존되어서 본 사령부의 감사를 받을 수 있도록 되어 있어야 한다.
